The Service

Darkniteglow.com, a subsidiary of Pete's Luminous Creations offers the use of it's online E-commerce system which consists of a shopping cart and payment gateway to merchants around the globe. You agree not to hold us or our partners responsible for any damages due to damaged products, delayed delivery or misrepresentations by its merchants.

Representation

While we try our best to present the product or service, as accurately as possible, through text and pictures, we cannot be held responsible if it does not meet your requirements or fails to perform as specified.

Delivery

We will do our best to ensure that the products you order, would be received in good condition, within the shipping period as stated here. The stated delivery time may vary depending on payment processing, stock level and other general shipping delays like customs etc.

For Insurance purposes, we declare the full value of goods. Overseas customers might be taxed by their customs officials because of this. We are not liable for overseas taxes.

Returns

In the event you are dissatisfied, with any product and return it to us within 30 days of purchase, we will refund the full value of the product, based on the condition we receive it in. Shipping charges are non-refundable. We will send you an email advising you of our decision within 7 days after receiving the returned product.

Credit Card Fraud

We have employed certain mechanisms on our site to counter this. We take credit card fraud seriously and would report all such cases to the relevant authorities.

Sensitive Products

Environmentally sensitive products might perform differently when tested under different environments. You agree that the data or claims of a product's performance is only good when tested under that environment and might differ when brought elsewhere.

Copyrights

All products, services, photographs, web pages and other items displayed on our entire site are the property of their respective owners. By purchasing these products or services, you agree to use them only in the manner agreed upon and not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of this site, its products, its services and its trademarks. Doing so, infringes the rights of the respective owners and action would be taken against those that do.

Indemnity

You agree to indemnify and hold Global Mall, and its subsidiaries, affiliates, officers, and employees, harmless from any claim or demand, arising out of the content, use of service or dissatisfaction of the services or products offered.

Sever ability

In the event that any portion of this Agreement is found to be void, illegal or un-forcible, the validity and enforceability of other portions shall not be affected.

Governing Law

The law of Singapore shall be applied to this agreement. The prevailing party shall be entitled to all costs and fees including reasonable attorney's fees.

Changes

We reserve the right to change the prices, terms, conditions and disclaimers at any time. However, any new changes would not effect confirmed orders received before the change was implemented or this date May 2, 2004
